Acceptable Use Policy
PLEASE READ CAREFULLY

Violation of any of the terms and conditions of this Agreement may result in the immediate cancellation of your account without notice to you.

American Broadband.net services may be used only for lawful purposes. Transmission or solicitation for reception of any material which violates federal or state law is prohibited, including, without limitation, material which is legally obscene, threatening, or libelous. American Broadband.net reserves the right to monitor any and all communications through or with American Broadband.net facilities. You agree that American Broadband.net is not considered a secure, private communications medium.

You agree that the security of your account, including the data you store, transmit and receive through it, is your responsibility. You further agree that if you believe your account security has been compromised in any way to notify American Broadband immediately.

American Broadband makes no warranties or representations of any kind, including warranties of merchantability or fitness for particular purpose. American Broadband does not guarantee uninterrupted service. American Broadband is not responsible for any loss you suffer, including, but not limited to, loss resulting from delays in service, incorrect or incomplete delivery of information, computer viruses or interruption of service. American Broadband is not responsible for the contents of your mailbox, any personal storage, or other materials in your account even if stored on American Broadband's servers.

In addition, American Broadband prohibits users from "SPAM"ing, which includes the following, or any other actions which American Broadband, in its sole discretion believes to be harmful to itself, its other subscribers or the internet generally:

  1. To post a single article or advertisement on an excessive number of Usenet or other newsgroups, forums, or e-mail mailing lists;
     

  2. To post to any Usenet or other newsgroups, forum, or e-mail mailing list, articles which are off-topic according to the charter or description of the group or list;
     

  3. To send unsolicited e-mail, if such e-mail provokes complaints from the recipients;
     

  4. To engage in any of the foregoing activities using the service of another provider, but channeling such activities through a American Broadband account or remailer, or using a American Broadband account as a maildrop for responses; or
     

  5. To falsify user information, including the falsification of e-mail addresses, provided to American Broadband or to other users of the service in connection with use of American Broadband service.

Engaging in one or more of these practices, or violating any other term of this policy may result in any or all of the following:

  1. Dropping of mail messages that do not contain the proper and necessary information;
     

  2. Termination of the offender's account and/or access to American Broadband services without prior notice;
     

  3. Informing the appropriate legal authorities of the offender's actions upon receipt of appropriate subpoena or other request;
     

  4. Billing the offender for American Broadband's resources consumed, including bandwidth, CPU cycles, administration labor, or downtime.

American Broadband reserves the right to terminate your account for any reason at any time. This agreement supersedes any written or oral communication you may have had with American Broadband, and is the complete and total agreement between the parties.
